1. Acceptance of Terms
By accessing or using the South African Arts Creative Network (SAACN) platform ("the Platform"), you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the Platform. SAACN reserves the right to update these terms at any time with notice provided via the Platform.
2. Platform Purpose
SAACN is a digital community platform connecting South African artists, creatives, event organisers, and art enthusiasts. The Platform provides tools for artist discovery, marketplace listings, event promotion, creative collaboration, skills development, and community engagement.
3. User Accounts & Eligibility
You must be 18 years or older to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account. You agree to provide accurate, truthful information when registering and updating your profile.
4. Content & Intellectual Property
You retain full ownership of all original content you upload to SAACN (artworks, music, videos, writing). By uploading content, you grant SAACN a non-exclusive, royalty-free licence to display and distribute your content on the Platform for the purpose of promoting your work. You must not upload content that infringes third-party intellectual property rights, contains illegal material, or violates community standards.
5. Marketplace & Transactions
SAACN facilitates connections between buyers and sellers but is not a party to any transaction. All sales are between the buyer and the artist/seller directly. SAACN is not responsible for disputes, non-delivery, or fraud between parties. Users are encouraged to conduct due diligence before completing any purchase.
6. Community Standards
All users must engage respectfully. Hate speech, harassment, discrimination based on race, gender, sexual orientation, or disability is strictly prohibited. SAACN reserves the right to remove content or suspend accounts that violate community standards without prior notice.
7. Grants & Funding Information
Grant and funding information on the Platform is provided for informational purposes only. SAACN does not guarantee the accuracy, completeness or availability of any listed grant. Users should verify all information directly with the relevant funding organisation.
8. Privacy & Data Protection
SAACN collects and processes personal data in accordance with the Protection of Personal Information Act (POPIA) of South Africa. We collect only data necessary for Platform functionality. Your data is never sold to third parties. You have the right to access, correct, or request deletion of your personal data by contacting us at privacy@saacn.co.za.
9. Security
SAACN employs industry-standard security measures including OAuth 2.0 authentication, encrypted data transmission (HTTPS/TLS), and secure cloud infrastructure. Users are responsible for keeping their login credentials secure. Suspected account compromises should be reported immediately to security@saacn.co.za.
10. Limitation of Liability
To the maximum extent permitted by South African law, SAACN shall not be liable for indirect, incidental, or consequential damages arising from use of the Platform. SAACN's total liability shall not exceed the amount paid by you (if any) for platform services in the 12 months preceding the claim.
11. Governing Law
These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the courts of South Africa.
